Introduction:

The subclass 457 visa is for skilled workers from outside Australia who have been nominated and are sponsored by a business to work in Australia on a temporary basis.
A business can sponsor a skilled worker if they cannot find an appropriately skilled Australian citizen or permanent resident to fill a skilled position listed in the Consolidated Sponsored Occupations List, which includes over 1,000 occupations.
After working for their employer for two years, applicants will be eligible to apply for a subclass 186 permanent resident visa through the Temporary Residence Transition stream.

Advantages:
  • A 457 visa can be valid for up to four years.
  • In many cases, there is no English requirement.
  • The processing time is relatively short – usually around 90 days.
  • After two years, a 457 visa holder is eligible to apply for a 186 permanent resident visa.

Introduction:

There are several categories of student visas. The student visa subclass under which you will be assessed is determined by your main course of study, even if you are studying a package of courses.
The main subclasses of student visas are:

English Language Intensive Courses for Overseas Students (ELICOS) – Subclass 570

For primary, junior secondary or senior secondary school courses, and approved secondary school exchange programs.

Primary or Secondary School Course – Subclass 571

For stand-alone English language courses that lead to a Certificate I, II, III or IV, or which result in no formal Australian award.

Vocational Education and Training (VET) – Subclass 572

For courses that lead to a Certificate I, II, III or IV (except ELICOS), VET diploma, VET advanced diploma, vocational graduate certificate or a vocational graduate diploma.

High Education – Subclass 573

For higher education courses that lead to a bachelor degree, associate degree, graduate certificate, higher education diploma, higher education advanced diploma or a master’s degree by coursework.

Postgraduate Research – Subclass 574

For a Master’s Degree by research or a doctoral degree.


Introduction:

The permanent employer sponsored visa program allows employers to sponsor highly skilled foreign workers who are currently in Australia on a temporary basis or located outside of Australia for permanent residence to fill vacancies in their business.

Two Visa Categories & Three Streams:

There are two employer sponsored visa categories:

  • the Employer Nomination (Class EN) Employer Nomination Scheme (Subclass 186)
  • the Regional Employer Nomination (Class RN) Regional Sponsored Migration Scheme (Subclass 187).

Each visa category is made up of three streams:

  • the Direct Entry stream is for applicants who are untested in the Australian labour market and have not held a subclass 457 visa for at least the last two years or who are applying directly from outside Australia.
  • the Temporary Residence Transition stream is for subclass 457 visa holders who have worked for their employer for at least the last two years in the nominated the wants to offer them a permanent position in that same occupation.
  • employer occupation and the Agreement stream is for applicants who are being sponsored by an employer through a tailored and negotiated labour agreement or regional migration agreement.

Introduction:

There is a range of visa options under the General Skilled Migration Program for skilled workers who want to live in Australia and who do not have an employer to sponsor them. These include applying as an independent migrant as well as being sponsored by a relative, or nominated by a State or Territory government.

Skill Select:

SkillSelect is a major change to the General Skilled Migration program. It is an online service that enables skilled workers and businesspeople interested in migrating to Australia to enter their details to be considered for a skilled visa through an Expression of Interest (EOI). Since 1 July 2012, all prospective migrants interested in the points-based skilled migration or business investment & innovation visa programs are required to submit an EOI and receive an invitation in order to lodge a visa application. The Family stream seeks to reunite Australian citizens, Australian permanent residents and eligible New Zealand citizens with their close family members. There are a number of migration options for fiancé(e)s, partners, children, parents and other family members of Australian citizens, permanent residents or eligible New Zealand citizens, divided into four categories – partner, parent, child and other family. Introduction:

The aim of the Business Skills category is to attract people with a demonstrated record of business or investment activity who are committed to using their business and/or investment skills in Australia.
The majority of business skills entrants will initially enter Australia on a provisional (temporary) visa for 4 years. After providing evidence of a specified satisfactory level of business or investment activity, they may then apply for permanent residency. This pathway to permanent residency is designed to provide certainty and clarity to provisional business migrants and relies upon the establishment, maintenance and management of genuine business activity in Australia.
There are also provisions for high calibre business migrants to obtain upfront direct permanent residency through the Business Talent (Migrant) visa category if they have high level business attributes and are sponsored by a state or territory.

Provisional Visa (subclass 188):

The provisional Business Innovation and Investment visa is part of the Australian Business Innovation and Investment Program, which seeks to develop Australia’s economy. Applications for this visa are invitation-only. In order to be invited, you must first lodge an Expression of Interest through SkillSelect.
This visa has three streams:

1. The Business Innovation stream is for people who wish to own and manage a new or existing business in Australia.

2. The Investor stream is for people who wish to make a designated investment in an Australian state or territory and who wish to maintain business and investment activity in Australia after the original investment has matured.

3. The Significant Investor stream is for people who wish to invest at least $AUD5 million into complying investments. This visa commenced on 24 November 2012.

Business Talent (Migrant) (Subclass 132):

This visa is designed for high-calibre businesspeople who are owners or part-owners of an overseas business, and who have a genuine and realistic commitment to participate in the management of a new or existing business in Australia. Applicants must be sponsored by a state or territory government. Applications for this visa are invitation-only. In order to be invited, you must first lodge an Expression of Interest through SkillSelect.
This visa has two streams:
1. The Significant Business History stream is for affluent owners or part-owners of a business who wish to have a major management role in a new or existing business in Australia.
2. The Venture Capital Entrepreneur stream is for people who have raised at least $AUD1 million in funding from an Australian venture capital firm.
